These Terms govern your use of the Keweenaw Trails app ("the App"), operated by A Superior Transportation and Logistics Company LLC ("Company," "we," "us"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
Trail data comes from public sources (including the Michigan DNR) and from other riders, and may be inaccurate, outdated, incomplete, or missing entirely. Roads, trails, and points of interest may be shown incorrectly or not at all. Weather and hazard information may be delayed or wrong. The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including fitness for a particular purpose.
You are solely responsible for operating your vehicle legally and safely, for knowing and obeying all laws, trail permits, posted signs, closures, and private-property boundaries, and for not riding where it is illegal to do so (for example, highways and freeways are marked in the App as illegal for ATV/ORV travel — do not ride on them). You are responsible for your own safety, equipment, and preparation.
To the fullest extent permitted by law, you release, waive, and discharge A Superior Transportation and Logistics Company LLC, its owners, members, employees, and affiliates (the "Released Parties") from any and all claims, liabilities, injuries, damages, or losses arising out of or related to your use of the App, including but not limited to: accidents, crashes, injury or death; getting lost, stranded, or delayed; reliance on trail, road, weather, location, or hazard information; riding on closed, private, illegal, or unsafe routes; failure of the SOS, crash-detection, or location features to work or to summon help; and any act or omission of you or any third party. You agree to indemnify and hold harmless the Released Parties from any claim brought by you or any third party arising from your use of the App. You use the App at your own risk.
To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the App. Where liability cannot be excluded, it is limited to the amount you paid us for the App (which, for riders, is $0).
Location sharing, crash detection, stranded detection, and SOS are convenience features that depend on your device, sensors, permissions, battery, and cellular/satellite coverage. They may not work when you need them. Never rely on the App as your only means of getting help. In an emergency, call 911.
Paid business listings are advertisements purchased through Square. Advertisers are solely responsible for the accuracy of their information and for operating their business lawfully and with all required licenses and permits. We collect business and licensing information to keep listings accurate, but we do not verify, endorse, or guarantee any advertiser, and inclusion is not a recommendation. Listing fees are described at purchase; coupons may apply.
Your use is also governed by our Privacy Policy.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Michigan.
